2nd Constitution of the INWU

Constitution of the International Northwestern Union
Preamble of the Constitution

It is the firm belief of the writers and signers of this Constitution that democracy and equality among nations be established within the region of the International Northwestern Union. The goal of this Constitution is to enable the nations of the International Northwestern Union, hereby referred to in abbreviation as INWU, to achieve this belief through peace, security, and prosperity.

Government of the INWU

The government of the International Northwestern Union shall be chosen by and composed of the people, with the exclusive responsibility of serving the interests of the INWU’s citizens and the region.

Article One: The Executive Branch

  • The Executive Branch shall compose of the Founder, the World Assembly Delegate, and the Chancellor. They are charged with preserving peace and cooperation within the region.

  • If a post is suppressed by one of the executives, the others are not permitted to unsuppress it, with the exception of a court order declaring a post be unsuppressed. The executives may suppress posts that explicitly violate NationStates rules.

  • Any of the executives may immediately eject and ban a non-citizen nation that threatens the peace and security of the region, but this may be overturned with a simple majority in the Regional Council.

  • The region may be password protected by any of the executives in case of an emergency, or through a preemptive vote by the Regional Council. If the region is password protected, the Council must approve of it within three days. If approval fails, the region must be immediately unlocked.

  • The World Assembly Delegate and Chancellor are charged with carrying out the laws of the region. They shall be elected every three months, in a two day long election each, by all of the citizens of the region.

  • The World Assembly Delegate or the Chancellor shall be automatically impeached if either respective nation is inactive for seven days without notice, or fourteen days with notice. If the World Assembly Delegate is impeached, the Chancellor shall take over his or her duties as the new World Assembly Delegate. If the Chancellor is impeached, an election shall be held to fill the position.

  • All three executives shall automatically have a position on the Regional Council.

Article Two: The World Assembly Delegate

The World Assembly Delegate has the responsibility to:
  • Enact and enforce legislation passed by the Regional Council and approved by the Regional Court.

  • Establish agencies or ministerial positions with the power to enforce the laws or help run the affairs of the INWU, if necessary. The heads of these agencies and the Ministers must be approved by a simple majority of present Council members in the Regional Council, and their term lengths are tied to the terms of the World Assembly Delegate. The agencies or the ministers must have a clear description as to what their duties are.

  • Defend regional sovereignty and foreign interests.

  • Establish embassies, appoint ambassadors, and communicate diplomatic information between the INWU and other regions. If the WAD wishes, he/she may appoint a foreign affairs minister to share these duties.

  • Manage the regional controls, unless in times of emergency, which can be declared by the Founder or the Legislature.

  • Ban and/or eject a citizen from the region after they have been found guilty by the Justices. Any nation that is not a citizen and threatens the peace and security of the region may be banned immediately, but this may be overturned by a simple majority from the Regional Council.

Article Three: The Chancellor
The Chancellor has the responsibility to:
  • Manage the Regional Council's debate periods and voting periods on legislation, and ensure that legislation is passed in a timely manner.

  • Nominate three Justices after each election for the Chancellor to replace the previous court, with the exception of recall elections. The Justices can be the same Justices who have previously served. These nominated Justices must be approved by a simple majority of the Region's citizens in a vote held on the forums.

  • Oversee conduct on the regional message board and in the forums. The chancellor has the power to suppress posts threatening the cohesiveness of the region.

Article Four: The Legislative Branch
  • All legislative action shall originate in the Legislative Branch. This Branch will compose of the Regional Council, located on the regional forums, in which all citizens may apply to join through an application on the regional forums.

  • To become a Council member, a citizen must pass through an approval process to show that they have been active and interested in government. Citizens who have no prior experience in government can demonstrate their interest by participating in the Council's discussions.

  • Council members can serve as long as they wish. To leave the council, they must write an official resignation. A Council member can be removed by a unanimous vote of the other council members in favor. Council members will be automatically removed if they miss more than seven votes without notification, or twelve with notification, if they fail to participate in at least two council discussions per month, or if they cease to exist. This shall be kept track of by the Chancellor, who will keep and update a list of all Council members, which shall be placed in the Legislature section on the Regional Forums.

  • Former Council members may apply to rejoin the Regional Council at any point in time after filling out an application for reinstatement.

  • For legislation to pass, it requires a simple majority of votes of present Council members in favor.

  • Amendments to this constitution, or newly written constitutions require a 2/3 majority of votes of present Council members in favor.

  • The voting period for all procedures requiring the votes of Council members shall be at least one day, with recall and impeachment votes lasting at least two. The voting periods may end early only if every Council member has voted. The Chancellor must notify the Council members that a vote is taking place by posting a notification on the Regional Message Board or by telegramming the Council members.

Article Five: The Judicial Branch

  • The Judicial Branch shall compose of three justices, who are charged with ensuring that the principles and rules outlined in this constitution are fairly upheld, and that all citizens of the region are protected by the law. They shall convene in the Regional Court on the regional forums.

  • The Justices shall decide amongst themselves who is the Chief Justice. If no decision is reached within three days, the Chancellor shall decide who the Chief Justice is.

  • All legislation passed by the Regional Council shall be reviewed by the Justices to ensure that the legislation is not unconstitutional. This is to be determined by a simple majority vote. A whole bill or pieces of a bill can be found unconstitutional, depending on the premise of the bill.

  • If legislation is found unconstitutional, the Chief Justice must issue a statement explaining the decision to the Council. The other justices may issue a statement of dissent. If the court rules that the legislation is constitutional, the Chief Justice must notify the World Assembly Delegate that the legislation has passed.

  • All deliberations in reference to Judicial Review will be documented as a topic under the Legislation Review sub-forum of the INWU Forum.

  • If a Justice is inactive without notification for seven days or more, or fourteen days with notice, he or she shall automatically be impeached and a new Justice shall be appointed. A Justice may also be impeached if 4/5 of present Council members vote in favor of impeaching that Justice.

Article Six: Preserving Representative and Democratic Governance
  • The World Assembly Delegate and the Chancellor may be recalled through the following process:

    • Seven citizens must sign a petition to poll the Regional Council, who will either pass or stop the motion to recall the official with a 3/5 majority of votes of present Council members in favor. The Chancellor and the World Assembly Delegate will not be able to vote on the motion. If this motion fails, then following motions require 15 petitioners.

    • If it passes, then the Justices will do a legal check on the executive's actions. If they find legal wrongdoing, the motion will become an impeachment motion, and a new election for the position will be held without the former official permitted to run. If there is no legal wrongdoing, then a recall election will be held, and a new election will take place for the position, in which the official may try to win re-election.

  • To become a citizen, a region member must pass through a process of naturalization, and then they are bestowed all the rights entitled to citizens as per this constitution. This is to better define who can participate in and be protected by the government. This process of naturalization shall take place on the regional forums.

  • A citizen may only be a candidate for one position. Citizens may only hold one government position at a time, with the exception made for Regional Council members unless specifically aforementioned otherwise. A candidate for a position may also hold an official elected position, but must resign from the former position if he or she is elected. Exceptions are made for minor positions, such as the ministers, and for the Founder, who may hold another position in addition to being part of the Regional Council.

  • All laws passed by former legislatures that are still in effect at the passing of this constitution will remain in effect.

Article Seven: The Rights of Citizens

  • All members of the region have the fundamental right to not be deprived of the following rights without due process of law.

  • All members of the region have the right to practice free speech and free publishing in accordance to the rules of NationStates, on both the Regional Message Board and the Regional Forums, as both are considered Regional territory.

  • All citizens have the right to petition the INWU’s government, the right to assemble and debate, and the right to protest.

  • All citizens have the right to privacy, and a warrant must be used to require a nation to forward any telegrams to the Court. Warrants may only be given by the Court.

  • All citizens are subject to the due process of law, and shall be considered innocent until proven guilty without reasonable doubt.

  • All citizens shall have the right to a fair trial, to unbiased legal advice, and to a lawyer. Instead of a single judge, the three justices are considered a jury.

  • A citizen cannot be tried twice for the same crime.

  • Citizens of the International Northwestern Union have additional rights not specified in the Constitution.

  • All powers not given to the government of the INWU are hereby granted to the citizens.

  • No Bill of Attainder or ex post facto law shall be passed.
