No Punishment Without Prior Law

Proposal Overview:
This proposal seeks to curtail the abuses of secret laws by requiring WA member-states to promulgate and make all recognised sources of law accessible to the general public. It also prohibits ex post facto laws and disproportionate punishment, and mandates that member-nations must provide judicial review and remedy to those wrongfully convicted or punished under these prohibited types of law. However, its protections do not apply to individuals claiming ignorance of the law, if said law was publicly promulgated at the time the criminal offence was committed.
Ministry Analysis:
The use of secret laws, ex post facto laws, and disproportionate punishment by national governments is a gross violation of civil liberties, and opens the door to horrendous abuses. By prohibiting these unjust infringements on personal freedom and requiring the public promulgation of laws, the proposal would effectively protect people's rights against cruel and arbitrary punishment, and ensure an equal and consistent enforcement of laws across member-nations.
