Third Charter of The Wellspring

United in our steadfast commitment to the autonomy and self-determination of our region and its Nations,
Governing only with the authority and consent of the individual Nations of The Wellspring,
Renewed in our dedication to fostering kinship among one another,
With reverence for our past and confidence in our future,
Proclaim the Third Charter of the Wellspring:
Article I: Rights of Nations
1. Sovereignty. All nations of The Wellspring are sovereign. Each nation has the right of self-determination in that nation's domestic policies, notwithstanding any declarations made by The Local Council.
2. Voluntary Participation. Participation in regional governance, including voting, candidacy for office, and member status in the World Assembly, is voluntary for all nations, subject to criteria proscribed by the Charter or law. No nation shall be obligated to endorse officials.
3. Equal Protection. All elections shall be free and equal. Nations may not be denied the opportunity to hold elected office except as prescribed by the Charter, by law, or as a result of a verdict in a criminal trial.
4. Fundamental Rights. All nations of The Wellspring are guaranteed the rights to free speech, free press, free expression of religion, privacy, peaceful assembly, and to petition the government for the redress of grievances.
5. Anti-Discrimination. Discrimination by any nation based on that nation’s identity, origin, beliefs, or personal characteristics, real or perceived, is prohibited. The government of The Wellspring shall ensure the equal and fair treatment of all nations and equal protection under the Charter and laws. No law shall be enacted granting to any nation or class of nations privileges or immunities which, upon the same terms, shall not equally belong to all nations.
6. Privacy. No nation shall be disturbed in their private affairs without authority of law nor under any circumstance compelled to disclose any private personally identifying information.
7. Rights of Accused. In all criminal proceedings, nations accused of an offense shall have the right to a fair, impartial, speedy, and public trial. No nation shall be compelled to testify against themselves, tried twice for the same offense, or subject to disproportionate punishment. Nations shall have the right to know the cause and nature of their accusation, confront accusers, and present evidence. Nations accused of crimes shall be presumed innocent until proven guilty by reasonably certain evidence.
8. Due Process. The government of The Wellspring shall not deny due process of law, pass ex post facto laws or bills of attainder, or unreasonably and without good cause delay in charging or prosecuting a nation.
9. Freedom of Movement. Nations may join and leave the region freely. Nations who leave the region shall have their citizenship and governmental roles vacated, except in circumstances explicitly provided for by law or judicial process.
10. Ejection. The regional power of ejection and banning may not be granted or exercised unless expressly authorized by the Charter or the law. Any ejected or banned nation is entitled to prompt judicial review of the matter.
11. Mandatory Adherence. The provisions of this Charter are mandatory unless by express words they are declared to be otherwise.
12. Implied Rights. The enumeration in this Charter of certain rights shall not be construed to deny others retained by the nations of The Wellspring.
13. Reserved Powers. Powers not enumerated in this Charter shall be reserved to the member nations.
Article II: The Druidic Council
1.Legislative Power. Supreme legislative power shall be vested in the Druidic Council, which shall be composed of all citizen nations of The Wellspring.
2. The Sage. The Sage shall organize and preside over all proceedings of the Druidic Council and shall enforce order in the chamber. The Sage shall have discretion in interpreting the Druidic Council’s rules.
3. Deputy Sage. The Sage may appoint a Deputy Sage to assist in executing the duties of the office. In the event of the Sage’s resignation, recall, or ejection, the Deputy Sage shall serve as Acting Sage until the Druidic Council elects a new Sage or until the end of the Sage’s term, whichever occurs first.
4. Acting Sage. In the event of the Sage’s resignation, recall, or ejection without a Deputy Sage, the Archdruid shall appoint an acting Sage to serve until the Druidic Council elects a new Sage or until the end of the Sage’s term, whichever occurs first.
Power to Enact. The Druidic Council may enact legislation and treaties. Only the Archdruid can propose a treaty, and treaties may not be passed without the Archdruid's signature, regardless of the majority of the vote, and the Archdruid's veto of a treaty cannot be overridden.
6.Power to Resolve. The Druidic Council may pass resolutions declaring policy recommendations and objectives.
7. Power to Elect. Unless otherwise specified in this charter, all elections shall occur in the Druidic Council. No officer may be elected without obtaining a majority of the votes of the Druidic Council in a given election.
8. Power to Recall. The Druidic Council may vote to recall any official in this Charter following the processes outlined in Article VI.
9. Power to Amend the Charter. The Druidic Council may amend or replace this Charter by a two-thirds majority vote.
10. Legislative Enactment of Legislation. Any legislative proposal or amendment passed with at least a three-quarters majority vote shall be enacted and will become immediately effective.
11. Presentment of Legislation. Any legislative proposal or amendment passed with a majority vote but less than a three-quarters majority vote shall be presented to the Archdruid. If the Archdruid approves of the proposal, they shall sign it and the proposal will become immediately effective. If The Archdruid does not approve of the legislation, they shall announce their veto of the legislation to the Druidic Council. If, seven days after The Druidic Council passes a proposal or amendment, the Archdruid has neither signed nor vetoed the legislation, then the legislation shall be enacted.
12. Passage of Vetoed Legislation. When the Archdruid vetoes a passed proposal, the Druidic Council shall hold a second vote on the proposal following the same rules and procedures as the original vote. If the proposal passes the Druidic Council with at least a two-thirds majority, it shall become immediately effective.
13. Rulemaking. The Druidic Council shall define its own rules and procedures. The Druidic Council shall also define its own election procedure.
Article III: The Grove
1.Executive Power. The executive power shall be vested in an Archdruid and their Grove of Artificers.
2. The Archdruid. The Archdruid shall serve as Head of Government and is responsible for administering the affairs of the region.
3. Interregional Affairs. The Archdruid shall serve as Head of State and is responsible for representing The Wellspring in global politics, the World Assembly, and other interregional affairs.
4. Deputy Archdruid. The Archdruid may appoint a Deputy Archdruid. In the event of the Archdruid’s resignation, recall, or ejection, the Deputy Archdruid shall serve as Acting Archdruid until the Druidic Council elects a new Archdruid or until the end of the Archdruid’s term, whichever occurs first.
5. Acting Archdruid. In the event of the Archdruid’s resignation, recall, or ejection without a Deputy Archdruid, the Circle of Artificers shall, by a majority, appoint an acting Archdruid to serve until the Druidic Council elects a new Archdruid.
6. Power to Appoint Artificers. The Archdruid holds the sole authority to appoint Artificers. At their discretion, the Archdruid may defer an Artificer’s appointment to the Druidic Council.
7. Mandatory Guilds. The Archdruid must appoint an Artificer of Internal Affairs and an Artificer of Foreign Affairs. The Druidic Council may by a majority vote designate or remove other mandatory Guilds.
9. Discretionary Guilds. The Archdruid may create and dissolve other Guilds at their own discretion.
10. Deputy Artificers. Either the Archdruid or the Artificer of a Guild may appoint other citizens as Deputy Artificers. The Archdruid may appoint a Deputy Artificer in any Guild, and an Artificer may appoint Deputy Artificers only to their own guild. A citizen may serve as a Deputy Artificer while also serving as an Artificer or Deputy Artificer in another Guild.
11. Removal and Recall of Artificers. Artificers may be removed by the Archdruid or recalled by a majority vote in the Druidic Council.
12. Removal and Recall of Deputy Artificers. Deputy Artificers may be removed by the Archdruid or the Artificer leading the relevant Guild or may be recalled by a majority vote in the Druidic Council.
Article IV: The High Warden
1. Judicial and Advisory Powers. The judicial powers of The Wellspring shall be vested in a High Warden. The High Warden shall serve as a judge on all criminal cases.
2. Authority to Advise and Interpret. The High Warden shall serve as an advisor to the Druidic Council and the Grove and shall have the authority to interpret the Charter and the laws of The Wellspring when called upon.
3. Authority to Appoint. The High Warden shall have the authority to appoint up to two additional wardens for advice on any singular matter. These wardens shall be subject to recall by a majority vote of the Druidic Council.
Article V: The Circle of Keepers
1. Security Power. The supreme security power in The Wellspring shall be vested in a Circle of Keepers, consisting of three appointed Keepers.
2. Delegacy. The Circle of Keepers shall hold the in-game position of World Assembly Delegate. Every Keeper shall hold the position for a term of four months, rotating the position evenly among themselves in an order determined by the Circle of Keepers.
3. Gameside Authority. The Circle of Keepers shall appoint regional officers gameside and maintain the region’s World Factbook Entry.
4. Equality among Keepers. All Keepers shall be viewed as equals regardless of delegacy status, declarations of emergency, or any other temporary authority granted by law. No security decision shall be made except by a majority vote of Keepers.
5. Expansion of the Circle. The Circle of Keepers may by a majority vote of the current Keepers temporarily or permanently expand the number of Keepers in the Circle. They must announce whether the new member or members are temporary or permanent at the time of expansion. A majority vote of the permanent Keepers may remove temporary Keepers.
6. Appointment of Keepers. In the event of the removal or the resignation of a Keeper, the remaining two Keepers shall unanimously appoint a third Keeper. In the event of the resignation of multiple Keepers, the remaining Keeper shall appoint two new Keepers. In the event of the resignation of all three Keepers, the Archdruid shall appoint new Keepers.
7. Determining Citizenship. The Circle of Keepers shall create standards for citizenship. The Circle of Keepers may, by a majority vote, add, remove, or modify any standards. Standards for citizenship shall be published gameside and accessible via the region’s World Factbook Entry.
8. Granting Citizenship. The Circle of Keepers shall have the power to grant citizenship to anyone who meets their criteria.
9. Revoking Citizenship. The Circle of Keepers may revoke citizenship from any person who no longer satisfies the criteria for citizenship.
10. Border Control. The Circle of Keepers shall have authority over border control and may grant or revoke this authority to other citizens as they see fit.
11. Endorsement, Ejection and Banning. The Circle of Keepers may impose endorsement limits, and authorize the ejection or banishment of any nation or class of nations.
12. Declarations of Emergency. When The Wellspring faces an imminent military threat, or otherwise an imminent threat to the security of the region or the position of the legitimate in-game Delegate, the Circle of Keepers may, by a majority vote, declare an emergency. The Circle of Keepers may only end an emergency by unanimous vote.
13. Emergency Powers of The Circle of Keepers. While an emergency declaration is in effect, the Circle of Keepers shall be vested with supreme executive authority to restore order. No statute shall bind the Circle during an emergency, and, for the duration of the declaration, the Circle shall have unrestricted discretion to eject, banish, or remove nations from the regional ban list.
14. Judicial Powers of the Circle of Keepers. The Circle of Keepers may assume judicial jurisdiction in cases involving security concerns or appeals of a revocation of citizenship, an ejection, or a ban.
15. Establishing and Regulating a Military. No armed forces will be established without the consent of the Circle of Keepers, and the Circle of Keepers shall be the commanders-in-chief of any armed forces that exist.
16. Delegation of Powers. Except where specified otherwise in this Charter, the Circle of Keepers may delegate its powers to individual Keepers or exercise those powers collectively.
Article VI: Elections and Recalls
1. Election of the Archdruid. The Archdruid shall be elected to a three-month term. The elections of the Archdruid shall open within 24 hours of January 15, April 15, July 15, and October 15.
2. Election of the Sage. The Sage shall be elected to a three-month term. The elections of the Sage shall open within 24 hours of March 1, June 1, September 1, and December 1.
3. Election of the High Warden. The High Warden shall be elected to serve until their resignation, recall, or ejection. The elections of the High Warden shall open within 10 days of the seat becoming vacant.
4. Recall of Elected Officials. The Druidic Council may remove the Sage, the Archdruid, and the High Warden by a simple majority vote. Upon the recall of an elected official, the Druidic Council shall promptly begin an election to fill the spot. An acting official shall assume the office until the election has concluded.
5. Recall of Artificers. The Druidic Council may remove any Artificer by a simple majority vote. Upon the recall of an Artificer, the Archdruid may either appoint a new citizen to lead the Guild or may call for the Druidic Council to elect a citizen to lead the Guild.
6. Removal of Keepers. A Keeper may only be removed by a unanimous vote of the other Keepers. If the Circle of Keepers votes for removal, the petition shall be presented to the Archdruid for approval or denial. If approved, the Keeper is removed. If denied, the petition shall be presented to the Druidic Council for a final vote. If the Druidic Council approves the removal, the Keeper is removed; otherwise, they shall remain in office.
7. Vacant and Acting Offices. When an elected or appointed office is vacated due to resignation, recall, or ejection, an acting officer shall be appointed to fill the role. Acting officers shall have all of the powers and duties of the elected officer. The acting officer shall serve until the end of the elected term or until a new office is elected, whichever occurs first. If the Druidic Council recalls an acting officer, it must promptly open nominations for an election to fill the position for the remainder of the term.
8. Administration of Elections. The Sage shall administer the election of the Archdruid and the High Warden. The Archdruid shall administer the election of the Sage.
9. Suspension of Elections. The Circle of Keepers may, by a majority vote, suspend or reschedule elections during a civil contingency.
10. Delayed Elections. If an election is delayed for any reason, future elections will still take place on their scheduled dates.
11. Eligibility for Elections. Citizenship shall be required to hold any office defined under this Constitution or the law.
12. Separation of Offices. A person may not concurrently hold any combination of the offices of Archdruid, Sage, or High Warden. No individual may serve in more than one elected or acting office at the same time, though they may resign from an elected office to accept an acting appointment. If any such official holding one office is elected to another, they must resign from the office they currently occupy prior to assuming the newly elected or appointed position.
13. Citizenship Hold during Elections. No nation shall be granted citizenship during the voting period in any election.
14. Publishing an Election Calendar. The Sage shall publish and maintain a calendar of elections for the current calendar year.
Article VII: Off-Site Administration
1. Discord Server. The Wellspring’s Discord Server shall have the ID 1098644885797609492.
2. Administration of the Discord Server. The server’s administrators may amend the specified ID without the approval of the majority of the Druidic Council or the Archdruid’s signature. No part of this Constitution, nor any statute, constrains the Chief Administrator and their designated Administrators and Moderators in their roles as such.
Article VIII: Constitutional Supremacy
1. Sole Organic Document. This Charter is the sole organic document of The Wellspring and is not a statute.
2. Supercession. This Charter shall override the previous Charters of The Wellspring, but shall not affect the validity of laws passed under those Charters.
1. Passage. This Charter shall be adopted only upon a two-thirds majority approval of The Local Council.
2. Appointing the Circle of Keepers. Upon this Charter’s adoption, the Delegate of The Wellspring shall appoint two citizens to serve alongside the Delegate on the Circle of Keepers.
3. Transition of Elected Officials. Upon this Charter’s adoption, the following positions under the Second Charter will be appointed as following acting officials: The Archmage shall become the Archdruid. The Sage shall become the Sage. The Mages of the Grand Magisterium shall become the Artificers of the Grove and their Magisterium shall become their Guild. The office of the High Warden shall remain vacant.
4. Election of Officials. The Druidic Council shall pass an act outlining the procedure and schedule of elections. The first series of elections may cut short or extend the term of any elected official.
