Basic Law of Blue Ridge
Unless deprived of such by community leadership, all residents of Blue Ridge shall have the right to:
Maintain, within reason, a right to speak freely about the goings on of government and the goings on their fellow nations.
Free assembly within the region and the ability to associate freely within the region with, or without, fellow nations of their choosing.
Equal treatment under the law, such that no nation shall be considered not responsible to and above the law.
Set, insofar is as applicable within our community's prohibitions against fascism and the rules of the games which we inhabit, their national policies.
Report abuses by government officials, seek redress for grievances against said officials, and to speak ill of the current government in public fora.
Participate in the governance of the region in those manners and opportunities open and freely available to individuals within the region.
A vote, freely cast without demands on the nature of said vote, in any vote-taking body of which it is a part.
All nations possessing World Assembly status within Blue Ridge shall be considered citizens of the region.
Nations without World Assembly status desiring citizenship shall either:
Furnish proof to the Executive Council of why they cannot hold that status.
Furnish evidence of their membership in a foreign military that presently and actively requires their World Assembly nation, particularly if that nation is variable over time.
Provide proof of their World Assembly status via means to be chosen by the Executive Council.
Nations which do not satisfy the requirements in 2(2) and are not members of the World Assembly in the region shall not be considered Citizens, but shall be considered Residents and shall have the same rights as citizens exception the right to vote delineated in 1(7).
Citizenship shall not be withheld on the basis of non-endorsement save via an affirmative vote of the Executive Council or by means of a declaration of war.
All citizens shall have the right to stand for election to any office stated as elected throughout the Basic Law in addition to the rights delineated in Article 1.
The primary executive ruling over the region shall be the Executive Council.
The Chair of the Executive CouncilThe chief representative of the Council shall be the Chair of the Executive Council. The Chair of the Executive Council shall serve as convener of the Council, director of Council business, and shall be the nominal head of State for the region.
The Chair of the Executive Council shall be selected from among the current membership of the Executive Council.
Regulation of MembershipThe membership of the Executive Council shall consist of the Pioneer, the First Minister, and an Executive Councillor appointed by the Chair of the Executive Council upon the advice and consent of the other current members of the Executive Council.
In addition to the listed membership, the Executive Council shall consist of the Lookouts and the Convener of the Town Meeting as ex officio members if not already serving.
These three, as advisory members of the Executive Council, are entitled to express opinion on council ongoings but not participate in voting processes unless a tie is struck, in which case the Convener of the Town Meeting will cast the determining ballot. If the office of convener is vacant, or they choose to relinquish their vote, the Lookouts are to collectively cast a vote in their stead.
Rights and Duties of CouncilorsAll Executive Councillors, with the exception of the Pioneer, should serve concurrently as member of the Cabinet unless waived by the Chair of the Executive Council.
The Council shall strive for transparency in its deliberations. At any time, a member of the Town Meeting may petition for the right to review comments made on a narrow topic of their choosing. Excepting scenarios in which the Chair requires more time to prepare documents for readiness, the Chair shall provide full, appropriately redacted transcripts of conversations held upon petition.
The Executive Council must provide regular updates to the region at the interval it chooses upon its deliberations.
The Executive Council must also submit treaties to the Town Meeting for the upholding of the citizens' consent to enter into a treaty or revoke a treaty, if the revocation of the treaty is not done in the interest of the region's material security. The Executive Council must also submit all decisions to enter into an organization or leave an organization to the Town Meeting. In all scenarios in this clause, the threshold shall be a 3/5 vote.
Notwithstanding the procedural limitations listed above, the Executive Council has the right to create or dissolve any body that will report directly to it and the ability to formulate its own procedures and promulgate its own decisions or regulations on matters not expressly otherwise expounded upon in the Basic Law.
The Executive Council may, at its own discretion, appoint other executive officers to serve in the Cabinet.
As noted in Article 3(8) of this law, members of the Executive Council shall serve as members of the Cabinet unless waived by the Chair of the Executive Council. Additional membership shall serve solely as Minister(s) of the Cabinet.
The First MinisterThe First Minister shall be head of Government within the region and shall be responsible for the direction of the community and all policy decisions.
Every three months, on the 1st of August, November, February, and May, there shall be an election for the office of First Minister held by the means of a single transferable vote. This election is to last for three days, until the 4th of each aforementioned month, after which the First Minister will assume office.
Rights and Duties of the CabinetMembership of the Cabinet shall be inalienable during tenure of good service barring the resignation of the officeholder, removal by a 3/5 vote of the Town Meeting, or removal by an affirmative vote of the Executive Council.
Cabinet Ministers shall be those solely responsible for the execution of regional policy set by the Executive Council if they are not involved in the formulation of said policy and otherwise shall both set and formulate regional policy.
The Cabinet shall have the right to formulate draft bills for consideration by the Citizens' Council. Barring items submitted by the Executive Council, these shall be the highest priority items.
The Executive Council shall appoint the World Assembly Delegate and take all due measures to ensure they claim and retain the seat.
The World Assembly Delegate shall rbe selected unanimously by the Executive Council and should serve indefinitely, barring resignation or standing down by the Executive Council. The Executive Council is to review the service of the Delegate on the 1st of August, November, February, and May and from that determine if their efforts have been supplementary.
The World Assembly Delegate shall also be subject to recall. If the membership of the Town Meeting supports a motion by majority vote to replace the World Assembly Delegate, there shall be a challenge vote. If the World Assembly Delegate does not win a majority of votes claiming confidence, the Executive Council shall choose a new Delegate.
If instructed to vote in a certain direction by the Executive Council, The World Assembly Delegate shall vote in accordance with the Council's wishes.
The Delegate shall vote in the same direction as recommended by World Assembly monitoring bodies within the region. If they cannot, they shall submit their rationale to the Executive Council, who shall publish said rationale before the end of the voting period.
Citizens may select to participate in the Town Meeting.
The Town Meeting shall be the primary forum for the consideration of issues relevant to the citizenry, both internal and external.
The Town Meeting may petition the Executive Council with legislative motions to make certain policy decisions.
Membership of the Town Meeting shall be inalienable barring resignation from the Town Meeting or the passage of a motion to remove membership by a 3/5 vote.
The Convener of the Town MeetingThe members of the Town Meeting shall, with the assistance of the Executive Council in the process of election, elect a Convener of the Town Meeting every 3 months. Elections for this office shall be the first act undertaken by the new Town Meeting. The method for this election shall be the Single Transferrable Vote.
The Convener of the Town Meeting shall have an inalienable right to office during the tenure of their election barring their resignation or an affirmative 3/5 vote for removal by their fellow members of the Town Meeting.
The Convener of the Town Meeting is, as provided in Article 3(5), a member of the Executive Council.
The Convener shall:
Formulate standing orders and procedures for the Town Meeting.
Interpret statute law where called upon by the Executive Council, which shall be subject to overriding by the Supreme Court.
Maintain, on-site and offsite, the results of votes and any indices of law beyond the Basic Law.
Serve as the citizenry's voice within the Executive Council.
Rights and Duties of MembershipAny member of the Town Meeting may submit a draft bill for consideration by the Town Meeting.
Members of the Town Meeting must maintain either:
A record of the placement of their World Assembly nation.
Their World Assembly nation within Blue Ridge, excepting those cases wherein their World Assembly may be mobile for reasons approved by a higher authority.
There shall be formed four core government ministries, tasked as follows:
Ministry of Culture, responsible for the onsite and offsite organization of events for Blue Ridge.
The Ministry of Culture is to maintain a Department of the Newswire, which will be tasked with creating and publishing news publications for Blue Ridge.
Ministry of Foreign Affairs, responsible for the organization and management of external relations and the maintenance of the ambassadorial program.
Ministry of Home Affairs, responsible for assisting residents to integrate into Blue Ridge and assisting in the creation of onsite-specific initiatives.
The Ministry of Home Affairs is to maintain a Department of Recruitment, which will be tasked with overseeing regional recruitment efforts of a stamp and manual nature.
Ministry of World Assembly Relations, responsible for organizing Blue Ridge's World Assembly policy.
There shall be formed a regional military of the independent alignment, called the Militia, governed by the Executive Council.
A Captain-General of the Militia, appointed by the Executive Council, shall oversee all military affairs of the region.
There shall be formed a committee to oversee the regional roleplay selected and governed by the Executive Council.
The Roleplay Committee will be chaired by a Roleplay Director, nominated by roleplayers and subject to the Executive Council.
In all cases, the Basic Law is the supreme law of the region.
Amendment of the Basic Law may be initiated by any citizen who is a member of the Executive Council, Cabinet, or Town Meeting. In any case, proposed amendments to Articles 2-8 require a 2/3 majority to be adopted.
Amendments to Article 1 requite a 4/5 majority to be adopted.
Unless expressly approved by the Governor and the region has and maintains more than 250 endorsements on its World Assembly Delegate for a length of no less than 3 months, Blue Ridge may not become a Frontier but shall remain a Stronghold.
This provision shall be waived automatically if the Governor is deleted or ceases to exist.
Additional territories may incorporate into Blue Ridge, if expressly founded for the purpose, via the signification of assent by the Executive Council.
Regions founded for incorporation into Blue Ridge shall automatically take on the corpus of the law of Blue Ridge.
In the event the Executive Council deems a Frontier a viable option the region shall explore, Article 8(1) shall be waived if a 2/3 majority of the Town Meeting shall agree to create a frontier that is not Blue Ridge.
Additional territories may incorporate into Blue Ridge, if not expressly founded for the purpose, via a 2/3 affirmative vote of their citizenry and the signification of assent by the Executive Council. Upon incorporation, their native structures shall cease to exist and they shall take on the corpus of law of Blue Ridge.
A native native to the incorporated region shall serve as World Assembly Delegate. A representative of the region shall be granted observer status in the Executive Council for a period of 6 months.
The judicial power of Blue Ridge shall be vested in one Supreme Court (hereinafter "the Supreme Court").
No inferior courts shall be created or recognized within Blue Ridge.
The Supreme Court shall be constituted, organized and regulated only by statute enacted by the Town Meeting, which shall prescribe the composition, jurisdiction, procedure, appointment and removal of judges, and terms of office.
All citizens shall have the right to bring claims to the Supreme Court for violations of their rights under Basic Law.
Until the Supreme Court is duly established by statute, no body shall exercise judicial powers inconsistent with the rights guaranteed by Basic Law; the Executive Council shall guarantee an interim mechanism consistent with Basic Law and subject to review by the Supreme Court once established.
