TAA Rules & Regulations

Section A: Definitions

1. Delegate refers to the WA Delegate of TAA unless stated otherwise.

2. Regional officer(s) refers to one or more regional officers of TAA unless stated otherwise.

3. Residents are nations residing in the The Azure Archipelago.

4. Citizens are residents who hold World Assembly membership or are otherwise eligible by law.

Section B: Regulations

1. The Delegate is not an elected position at this time. Attempts to replace the Delegate by punishable by

   1. a 1 day ban on first attempt;

   2. a 3 day ban on second attempt;

   3. a 7 day ban on third attempt and subsequent attempts.

2. No citizen may obtain more endorsements than 80% of that which the Delegate possesses. Any citizen in violation of this regulation

   1. must return to compliance with regulations within 72 hours;

   2. will be ejected if compliance is not reestablished within 72 hours.

3. No Regional Officer, Citizen or Resident may seek independence or attempt to seek independence for The Azure Archipelago from the ACA. Such attempts are punishable by

   1. a permanent ban appealable after 30 days on first attempt;

   2. a non-appealable ban on second and subsequent attempts.

4. No Regional Officer, Citizen or Resident may subvert or attempt subvert the legitimate government of The Azure Archipelago.

   1. Violations of this rule are punishable by immediate ejection and/or an indefinite ban appealable immediately.

   2. The scope of this rule is limited to tag raids, stealth raids, coups and occupations.

5. Regional Officers may eject inactive Residents in order to prevent influence farming operations by stealth raiders.

   1. This is a precautionary measure and not a punitive one.

   2. Ejected nations may rejoin immediately.

   3. This rule shall not be used to remove active nations, instead please use the rule against subversion of the government.

6. No person is to spam the regional message board.

   1. Persons suspected of spamming are to be given a warning.

   2. Should the person be again suspected of spamming within 24 hours of the warning, they may be subject to ejection or an indefinite ban appealable immediately.

7. No person is to evade a ban through the use of alternate accounts. Persons who attempt to do so may be banned on sight.

8. Persons who wish to lodge appeals should contact the Delegate or Vice-Delegate.

Section C: Appointments

The Azure Archipelago Administration shall consist of the following bureau staff, to be appointed Regional Officers:

1. The Delegate, a Regional Officer with Executive, World Assembly, Appearance, Border Control, Communications, Embassies & Polls permissions.

   1. The Delegate is appointed by the ACA Delegate.

   2. The Delegate must hold ACA citizenship.

   3. The Delegate must reside in The Azure Archipelago.

2. The Vice-Delegate, a Regional Officer with Appearance, Border Control, Communications, Embassies & Polls permissions.

   1. The Vice-Delegate is appointed by the Delegate.

   2. The Vice-Delegate must hold ACA citizenship.

   3. The Vice-Delegate must reside in The Azure Archipelago.

3. The State Secretary, a Regional Officer with Appearance, Border Control, Communications, Embassies & Polls permissions.

   1. The State Secretary is appointed by the Delegate.

   2. The State Secretary must reside in The Azure Archipelago.

4. The Diplomacy Secretary, a Regional Officer with Communications, Embassies & Polls permissions.

   1. The Diplomacy Secretary is appointed by the Delegate.

   2. The Diplomacy Secretary must reside in The Azure Archipelago.

5. The Homeland Secretary, a Regional Officer with Appearance, Communications & Polls permissions.

   1. The Homeland Secretary is appointed by the Delegate.

   2. The Homeland Secretary must reside in The Azure Archipelago.

6. The Interior Secretary, a Regional Officer with Border Control, Communications & Polls permissions.

   1. The Interior Secretary is appointed by the Delegate.

   2. The Interior Secretary must reside in The Azure Archipelago.

7. The Defence Liaison, a Regional Officer with Appearance, Border Control, Communications & Polls permissions.

   1. The Defence Liaison is nominated by the ACA Chief of Defence Staff and appointed by the Delegate.

   2. The Defence Liaison must hold ACA citizenship.

   3. The Defence Liaison must be a member of the Airborne Armada of Coolness.

   4. The Defence Liaison should preferably be of marshal rank.

 
Section D: Bill of Rights

1. Residents and Citizens alike shall not be ejected or banned for any reason except for violation of Section B or Section H of this document.

2. Residents and Citizens alike have freedom of speech within the borders of the ACA and may conduct themselves in any way they see fit.

   1. RMB spam is not protected by this freedom.

3. Every Resident and every Citizen has the right to exist within our borders.

Section E: Executive

1. The Azure Archipelago Administration shall be the executive branch of The Azure Archipelago.

2. All members of the executive may issue directives within their assigned portfolios.

3. Directives have the power of law, similar to a bill, but may be unilaterally repealed by successive governments.

4. The executive is not an elected institution at this time.

Section F: Legislature

1. The Legislative Council is to be the legislature of The Azure Archipelago.

2. The Legislative Council is to consist of all citizens of The Azure Archipelago.

3. The Vice-Delegate shall be the presiding officer of the Legislative Council.

4. The Legislative Council may pass bills to introduce new laws, modify the rules and regulations or repeal previous bills.

5. The process for passing bills is as follows:

   1. A citizen introduces a bill to the council.

   2. The bill receives at least one second

      1. You cannot second your own bill

   3. A citizen posts a motion for a vote on the bill.

   4. The Vice-Delegate or other Regional Officer observes the motion and creates a poll.

   5. Each citizen gets one vote, with the weight of all votes being equal.

   6. If the bill is supported by half of all voters, the bill passes into the regional law.

Section G: Judiciary

1. The Judicial Tribunal shall be The Azure Archipelago’s court of last resort.

2. The Judicial Tribunal shall be comprised of:

   1. two Associate Justices, Regional Officers with Border Control & Communications permissions.

   2. one Chief Justice, a Regional Officer with Border Control, Appearance & Communications permissions.

3. The Chief Justice is to be elected by majority vote of citizens in the first week of each month.

   1. The State Secretary shall act as returning officer for the election.

   2. The election should use first-past-the-post voting.

4. The Associste Justices are to be elected by majority vote of citizens in the third week of each month.

   1. The State Secretary shall act as returning officer for the election.

   2. The election should use first-past-the-post voting.

   3. The top two candidates shall be elected to the court.

5. All Justices serve for a term of one month.

6. In the event that there is a vacancy on the court, by elections shall be held for the vacant posts. The appointees shall serve until the next scheduled election.

7. Any resident may file an initial appeal to the Delegate regarding any action by regional officers they deem inappropriate.

8. The resident may then file a further appeal to the Judiciary Tribunal if the appeal was unsatisfactory.

   1. In cases involving the Delegate, appeals are heard directly by the Judicial Tribunal.

9. The process for hearing a further appeal is as follows:

   1. A resident appeals to the tribunal by contacting the Chief Justice.

   2. The appeal request should include a list of involved parties as well as links to supporting evidence and a short statement detailing the reason for appeal.

   3. If the Chief Justice believes the appeal has merit, the tribunal contacts all involved parties and invites them to submit statements and evidence.

   4. The tribunal deliberates about the collected evidence.

   5. Justices may propose motions during deliberation, such as

      1. Establishing facts of the case as true

      2. Making recommendations to the Executive

      3. Adding, removing or modifying sanctions

      4. Modifying the list of parties to the case

   6. All motions must receive the support of the majority to pass.

   7. Each justice casts one vote and all votes hold equal weight.

   8. The Chief Justice then collates all the court’s decisions into a verdict and publishes a dispatch.

10. The resident may then file a final appeal in the following circumstances

    1. They have been subjected to a gross violation of due process; and

    2. Previous appeals have been unsatisfactory.

11. The process for final appeal is as follows:

    1. The Chief Justice is contacted by the resident with a statement outlining their case as well as links to supporting evidence. Final Appeals may be made on procedural grounds only.

    2. The Chief Justice then reviews relevant evidence and determines if due process was violated.

    3. In the case that due process was violated, the following action should be taken:

       1. Remanding the case to a lower court; or

       2. Reaching an amended verdict independently.

    4. In the event that an independent verdict is needed, the Chief Justice shall publish their findings in a verdict dispatch.

Section H: Special Provisions

1. Every section of this document may be amended except for this section.

2. No person may seek independence for The Azure Archipelago from the ACA without permission from the ACA.

3. No person may subject The Azure Archipelago to tag raids, stealth raids, coups or occupations.

4. Any persons in violation of this section are subject to immediate ejection and/or an indefinite ban appealable immediately.

5. Alternate accounts used to circumvent the aforementioned penalties shall be banned-on-sight.
