Information Protection Bill

Overview


Purpose

The bill seeks to replace the Classified Documents Act with more robust and enforceable language as well as protection for other types of information.

Implementation

The bill shall be implemented after the Classified Documents Act is repealed.

Proposed Law


  1. The following classes of information shall contain the following types of information:

    1. Sensitive:

      1. Any information that may be used to identify an individual in real life or in personal or private internet spaces not related to NationStates or The Leftist Assembly, as freely and solely determined by the individual to whom the information pertains

      2. General knowledge information that cannot be reasonably protected such as NationStates nation names, relevant non-NationStates usernames, times of activities, and other public information shall not be considered sensitive

    2. Secret:

      1. Any information created by or with relevance to anti-fascist military operations

      2. Any information created by or with relevance to any ongoing intelligence or counter-intelligence operation

      3. Any information created by or with relevance to the security, integrity, or integral operation of any embassy region or other allied organisation

      4. The identity of any friendly party of an intelligence or counter-intelligence operation

      5. The legally private deliberations of any Supreme Court made during a State of Emergency

      6. The legally private deliberations of the current Supreme Court

      7. The vote of any individual in any election in which votes are not made public

    3. Classified:

      1. Any information declared by unanimous consent of the Founders, Secretary, and Chief Justice to be classified

      2. The deliberations and findings of any concluded intelligence or counter-intelligence operation

      3. The deliberations of an active electoral committee

      4. The deliberations of or with relevance to the leadership of the Regional Office of Intelligence and Security

      5. The legally private deliberations of former Supreme Courts

      6. The official deliberations of or pertaining to the Ministry of Foreign Affairs

      7. The official deliberations of the current Cabinet

    4. Confidential:

      1. Any information declared by the Founders, Secretary, or Chief Justice to be confidential

      2. The deliberations of previous electoral committees

      3. The official deliberations of previous Cabinets

  2. The following protections and regulations shall apply to the following information classes:

    1. Sensitive:

      1. Information shall not be created, stored, transmitted, or utilised by the government of The Leftist Assembly

      2. Information shall not be released to any parties that the information is not pertinent to and shall be protected from release in all circumstances

    2. Secret:

      1. Information shall only be made available to governmental parties with a strict need to know for the information, with sole discretion of need to know belonging to the individual or entity creating said information

      2. Information shall not be released beyond parties with a need to know under any circumstances

    3. Classified:

      1. Information shall only be made available to governmental parties with a strict need to know for the information as well as the Founders, Secretary, and Chief Justice on request

      2. Information may be immediately released by a unanimous vote of all parties with legal access to the information

    4. Confidential:

      1. Information may be made available to any governmental party with a reasonable reason for access to the information and shall be made available to the Founders, Secretary, and Chief Justice on request

      2. Information may be immediately released by order of the party creating the information with the consent of the Founders, Secretary, or Chief Justice

  3. Any citizen may request the release of classified or confidential information through the following process:

    1. The requester shall inform the Chief Justice of the requested information to be released

    2. The Chief Justice shall communicate with the Secretary and Founders on the nature of the protected information

    3. If the Chief Justice, Secretary, and Founders unanimously agree that the information must remain protected, they shall not release the information and give a reason for the denial of request

    4. If the Chief Justice, Secretary, and Founders unanimously agree that the information can be released, they shall release the information and make it publicly available via a NationStates dispatch

      1. The Chief Justice, Secretary, and Founders may select to only release certain portions of the information

      2. Portions that remain protected must have an attached reason for protection

    5. If the Chief Justice, Secretary, and Founders cannot come to a unanimous decision on the status of information, the status shall be decided by the following process:

      1. The information shall be reviewed by the Supreme Court in private

      2. The Supreme Court shall determine the status of the information by a majority vote

      3. If the Supreme Court finds the information in its entirety able to be released, the Supreme Court shall release the information and make it publicly available via a NationStates dispatch

      4. If the Supreme Court finds the information in its entirety unable to be released, the Supreme Court shall not release the information and give a reason for the denial of request

      5. If the Supreme Court finds only part of the information able to released, they shall release the releasable portions of the information and make it publicly available via a NationStates dispatch, and include an attached reason for protection

      6. A tied vote shall result in the information remaining protected in whole, unless the Chief Justice, Secretary, and Founders can unanimously agree to partial release of the information

  4. Wrongfully and intentionally protecting information without need for protection shall be regarded as a moderate criminal offence

  5. Wrongfully and intentionally releasing information that have a need for protection shall be regarded as a gross criminal offence

  6. Illegally releasing protected information, regardless of intent, shall be regarded as a gross criminal offence
