A Citizenship/RPC Reform Act to integrate active and approved party member as Congressional members capable to participate in legislating and voting.

Preamble

RECOGNISING that Wintercrest’s the Revolutionary People's Congress is in need of more voices to contribute in legislation making. For the governing legislative body to include dedicated members of the Worker's Party so to better have a diverse voice and active chamber.

Therefore, this act sets forth the general procedure and requirements for active citizens/party members to apply and become a member of the Revolutionary People’s Congress and contribute further to improving the People's Republic of Wintercrest.

BE IT ENACTED by the order and the graces of our Revolutionary Leaders, the consent and advice of the Workers’ Party of Wintercrest, and elected representatives of the Revolutionary People’s Congress, we present this legislation as follows:


Article I
Necessity Clauses

  1. Recognising that, there is need for a proclaimed documented that explains the requirements and procedures for becoming a member of the Revolutionary People’s Congress,

  2. Acknowledging that the strength of the People's Republic lays in an active and large divers voice in the legislative chambers that allows the peoples voice, the will of the Wintercrest Worker's Party, and a greater umbrella for addressing concerns from the residents of Wintercrest to be heard.

  3. Welcoming the valuable contribution of the network of the many dedicated party members, loyal comrades which support and make up the People's Republic to which ascribe and adhere to its Socialist values and principles, and

  4. Affirming our core Zennyist-Piperist principles of consensus, common action, mutual respect, inclusiveness, transparency, accountability, legitimacy, and responsiveness of Wintercrest.

  5. In the passing of this bill, all currently active legal citizens within the date of this bill passing will automatically receive membership into the Revolutionary People’s Congress. Inactive congressional party members who received their membership will still be subjected to possibly having their memberships revoked due to inactivity.

We hereby, seek to implement these core procedures to our People's Republic, and present and enforce the following legislation,


Article II
Requirement and Road to RPC Membership

Definitions:
For the remainder of this document, take

  1. "Citizens" legal citizens and party members of Wintercrest and of the Worker'sParty.

  2. "District" to mean the regional party department area of Wintercrest internal and external affairs that each Governor has been designated as head, and

  3. "RPC" to mean the legislative branch of Wintercrest being the Revolutionary People's Congress


Requirements
The requirements are the steps needing to be taken before a citizen/party member can consider beginning the process to applying to become a member of the Revolutionary People’s Congress.

Steps:

  1. First and foremost the person wishing to join the legislative should hold legal status as a citizen and party member belonging to at least one party district.

  2. Must at least hold their citizenship status for two (2) weeks before their eligibility to apply for congressional memebership for the Revolutionary People’s Congress. A World Assembly membership will also be required, but may be present outside the region, so long as the WA Nation is registered on both their original citizenship, and congressional memebership applications. Must also be a roled member to at least one party district. Seek information on joining a party district by messaging the district governor of the district that best suits your abilities to contribute to the party.

  3. A citizen/party member can then submit their application in the designated channels on our discord server. If they need assistance, they can seek help by messaging a member of the people’s government.

  4. Requirements for membership shall be that the citizen/party member, once after they have their application approved by the Chairperson or General Secretary, then they must wait within a further period of three (3) months. During which time they must prove their ability to understand how the worker's party districts and government functions. A citizen can easily do this by being an active contributor in the party districts they hold membership in, or may join more than one district, and also show loyalty to the People's Republic by serving in the Revolutionary Worker's Army. The applicant citizen must show that they are committed to the prosperity of our people's republic and that they are willing to put their personal work into the region before being given rights to run for office and submit resolutions that can potentially become regional law.

  5. After their application period is completed, they can then submit a review with the Chairperson or General Secretary to then approve their membership as a Congressional Party Member. Then congratulations, you've passed the working steps comrade.

  6. The Revolutionary Leaders can also grant any individual the status of being a Congressional Party Member. This is for very rare situations, and only the RL has the authority to grant such an auto status. As well as the ability to revoke an individual's status.

Role of Congressional Party Members of the RPC

As stated in definition, the Revolutionary People's Congress is the legislative branch of the People's Republic of Wintercrest. The most powerful body of our regional government, intended to be the sole decision maker of the Worker's Party. Some of the roles you may play once granted membership are as followed:

  1. A congressional party member must read and follow the LinkRevolutionary People's Congress chamber procedures. Which will govern and regulate the legislative body and its individuals.

  2. As a member of the RPC, a few common privileges apart from being a citizen with the right to vote people into office is the right to now propose resolution bills to the chambers and have it motioned to be discussed or voted on by the Chairperson.

  3. You may vote in the election for Chairperson of the RPC, which only RPC members can vote for the head of the legislative branch, unlike how regular citizens can only vote in presidential elections, and can't run for office. You may now also run for a seat and a chance to become Chairperson (head of the legislative branch) or President (head of executive branch) of the People's Republic of Wintercrest. Obviously not both at the same time.

  4. You will also be eligible to be selected by the elected President to become a seated governor at the end of an election if chosen. Generally the people chosen are to be highly qualified and active contributor in their party district fields. So to have a stable and functional administration.

  5. You are also eligible to be chosen by the Chairperson and President to be seated as the General Secretary. Which is an acting assistant to both head of branches to help flex their capabilities when they need an extra hand or for when they go on vacation, mia, or cte.


    Article III
    Revoking Congressional Membership

    A congressional party member can, if they violate regional law, face the consequences of having their congressional memebership revoked. Another possibility is to have their citizenship or even residency revoked, depending on the circumstances and how far the Supreme Court deems the punishment shall be for a certain violation and the situation surrounding the individual. However this will just cover Congressional Party membership revokings.

    1. A congressional member can be subpoenaed before the Supreme Court and have their membership revoked for violation of any major law. Or placed of temporary time out at the judges decision.

    2. The membership can be revoked if the Chairperson, or President deems the individual actions unfit. They head's must present their case to the Supreme Court and the individual will face trials for whatever reason it my be. The court must not revoke a membership if the individual has not committed any listed or unproven crimes. The case will should be dismissed and if the membership is challenged more than once, then the individual may sue the head's and if the court finds the case justified, then the Supreme Court shall conduct an investigation on harassment and decide the ruling punishment innthe outcome of the case.

    3. An individual may have their Congressional Party membership revoked by the Chairperson to inactivity. The Chairperson must hold a five (5) day motion vote for the RPC to revoked any inactive member during the time of the motion. The Chairperson must have a registry of listed citizens and determine if an individual has been inactive for 30 days or more. The Chairperson may also petition the Revolutionary Leader to also grant an auto revoking for inactive members to speed up this process.

      Individuals holding positions as head of branches, or governor are exempt from having their memberships revoked with this motion. As their are steps in place to have them removed from office in order to sustain an active and stable government. In which place, if they have been removed from office for inactivity, they will still be considered a congressional party member until a revoke motion is held to purge the Revolutionary People's Congress of inactive citizens.

    4. A membership can not be challenged against a sitting head official. But may be subpoenaed and possibly removed from office. If the case if a high crime, then the removal from office will be followed with a revoked of membership and possibly citizenship and or residency.

    5. The Revolutionary Leaders has the ability to strip membership if deemed appropriate. Though they have to state the reasoning for doing so publicly.

    6. A membership can be stripped if the majority of the Revolutionary People’s Congress deem the person unfit or inactive. A member may call on the Chairperson to motion for a revoking of a citizen's congressional membership with a vote being 3/4 of the given votes. The member may object can plea a case of keeping their membership to the Supreme Court. If the Supreme Court decides the case, the ruling will be final, and a vote to revoking the membership can not be challenged for three months. However the Chairperson, if representing the majorityof the RPC, may plea to the RevolutionaryLeaders for overturning the decision and revoking the membership. In which case the congressional citizen will be back to regular citizenship status

    7. The individual may apply to regain their congressional status in one of two ways. First, reapplying for a congressional party membership and going through the usual process. Second, filing a case to the SupremeCourt to reinstall the individual membership status. In which case if the individual is being punished or is revoked by the Revolutionary Leader, then they must appeal directly to the Revolutionary Leader, which will hold the final decision.
