The Constitution of Rex Omnia




The Constitution is the acting Charter of the Rex Omnian Constitution and pertains to all Rex Omnians. The articles contained within this Constitution shall henceforth be established with firm resolve and great sacrifice as the governing principles by which the Rex Omnian Constitution shall conduct itself. May this great Constitution last forever in the great history of mankind, and become the beacon of light which we have sought to be.

Preamble

We the people of Rex Omnia, in order to form a more perfect nation, establish justice, insure domestic tranquillity, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the Holy Empire of Rex Omnia.

Section I

The Constitution of Rex Omnia shall be the Supreme Law of the Land, taking precedence over all other Law and Regulation, and shall not be overridden, infringed upon, limited by, nor subject to the provisions of Treaty, International Law, nor to the Rulings of Extranational Bodies or Non-Governmental Organizations.

Section II

All legislative powers herein granted concerning regional matters of Rex Omnia shall be vested within the central, unicameral Senate of Rex Omnia, which shall be compromised of one representative from each individual member-state. Criteria of electing or appointing such representative to the Senate are left up to the individual member-state. Such representatives shall be called Senators. Senators from Rex Omnia observer states and colonial possessions of member-states are allowed to lobby and produce speeches on the Senate, but have no voting privileges. The Congress of Rex Omnia and its forum shall be cited as the Senate of Rex Omnia.

Section III

At the first session of the Senate, the Senators shall conduct a vote to elect a Praetor. Such officer shall serve as the leader of the Rex Omnian Constitution. The Praetor will act has the head of all forums that the Senate may conduct, will conduct all foreign relations that the Senate deem acceptable, and will appoint positions that the representative sees fit to do so. The Praetor has powers not listed thereof and such extra powers delegated to the Praetor may be revoked or added by majority Praetor approval. The Praetor may be in their position of power until such time as they chose to resign from office, leave the residences of the Rex Omnian Constitution, or is voted out of power by two-thirds vote of the Senate.

Section IV

The Senators shall elect a Premier, whose duties shall reside solely within the Senate. The election of such position shall take place every four months and be decided upon by majority approval and the Premier may not be voted out of power. The Premier has the authority to veto any legislation, treaty, or measure that the Senate may ratify if it violates the Constitution of Rex Omnia. After such veto is taken, the measure may only be enacted if two-thirds of the current sitting Senate approves such measure with approval by the Praetor as well.

Section V

The Senate of the Rex Omnian Constitution has the power to negotiate inter-regional trade and to establish treaties between independent nations or separate regions. The Senate has the authority to intervene, with three-forth approval, in member-state nations if such member-state is deemed corrupted by the standards put forth by the Constitution. The Senators has the power to form a regional military in order to secure the defense of all member-states and regional possessions, it also has the authority to appoint Generals and conduct all recruitment necessary in order to form such defense. The Senate has the ability to dictate law, in which clauses and articles pertain to regional issues, and not interfere with the sovereignty of member-states. The Senate has the ability to form regional borders and purchase or claim joint-regional land. The Senate has the authority to make all laws that are proper and necessary for the execution of foregoing powers, or abilities vested within the Senate by member-states of Rex Omnia.

Section VI

The Senate shall keep a public record of all of its proceedings, however, if times that secrecy is required as defined by the Senate then the records may be declared sealed and not of public knowledge. The fors and againsts of all senators shall be included in the public record, unless one fifth of those present decree that such voting records be sealed from the public. The Senate must enable all laws ratified to be announced publicly and be placed in the Rex Omnia Public Records which shall be a collection of this constitution and all documents ratified by the Constitution and administered by an appointed senator by majority Senate approval.

Section VII

The Rex Omnian Constitution may bar nations from residing in Rex Omnia by majority approval by the senate. The foreign nation may not appeal the result until a period of one-month has passed. If the Rex Omnian Constitution wishes to expel a nation from its borders and the nation has not committed infractions against pre-existing laws of the Rex Omnian Constitution, the latter would result in immediate expulsion pending Senate trial. If they did not, the Senate will conduct a referendum and two-thirds approval will be required to expel the nation from the Rex Omnian Constitution for a given time decided upon with both Premier, and Senate approval.

Section VIII

To be able to send a representative to the Senate, one must gather the support for approval from one-third of the current Senate member-base. In addition, the nation must have the support of either the Praetor or the objective Premier. Once one of them have declared their support in addition of one-third support of the current member-base the nation is now considered a member-state of the Convocation and may send a representative to the Senate. If two-thirds of the current Senate member-base agree with the approval of the nation in question, then the foreign nation may disregard the opinions of both the Praetor and Premier, and shall be regarded as a member-state of the Senate.

Section IX

In times of emergency or war, the Praetor will be appointed to serve for six months and will be renamed Imperator; however, during this period he holds complete authority. When an Imperator (Emperor) is in power there will be no Senate. The Imperator will the ultimate ruler and emperor.

Section I

A free-trade policy between member-states shall be in effect at all times while the nation is a resident of the Rex Omnian Constitution. Such policy includes that member-states shall be a preferred, but not mandatory, trading partners of other member-states. Member-states may not embargo another member-state without popular approval of the Convocation. No tariffs shall be placed on any member-state by another member-state, unless special approval is approved by the Senate.

Section II

In the industries of pharmaceuticals, poultry and/or other food-related industries, or any other high-care industries, or military grade industries, member-states may elect to bar other member-states from trade of such industrial products due to individual safety concerns, thus Rex Omnia shall not interfere with the industries thereof.

Section III

Land, aerial, and naval trade routes between member-states will be defended by Rex Omnian Military Institutions in correspondence with individual nations active military personnel. All protection of such trade is voluntary, if a member-state wishes to be excluded from protection or for a certain transaction then the Rex Omnian Constitution shall oblige. Protection within the exclusive economic zone shall be guaranteed as well as protection of private vehicles outside of such, all attacks on such shall be deemed a declaration of war.

Section IV

In the event of economic recessions or depressions within nations residing in Rex Omnia the Senate may dictate loans to individual member-states, with majority approval. The Senate may also assist member-states if asked for in all ways possible to ensure total and complete economic revival of their state. Loans may not exceed individual national budget totals as an effort to keep loans fair and even throughout Rex Omnia, and to ensure that unusual loans are not given. If a nation's poverty level rises above 20% and the individual member-state requests intervention, then such shall be given immediately. Such levels are classified as inhospitable nations and emergency funds are deemed acceptable to be given out to the nation's economic regulators under regulation by the Senate.

Section V

Rex Omnia reserves the right to bar foreign nations from conducting trade or other activities within the exclusive economic zone of Rex Omnia or its territorial waters, if the Senate gives majority approval. The Praetor can issue a temporary writ of prohibition to bar a foreign nation from entering Rex Omnian waters and may force a foreign nation to leave if the Praetor believes that the foreign nation causes a security risk. As soon as possible, the Senate shall assemble and conduct a vote in which a majority is required to ratify the writ of prohibition, if failed, then the foreign nation shall be allowed back into Rex Omnian waters with an official apology by the Praetor.

Section I

The Senate shall establish an army in times of war. This army will be made up of Rex Omnian Imperial Legion.The Holy Empire of Rex Omnia may establish a standing army based on the situation. These shall be under the control of the Praetor. The Praetor shall act as the commander-in-chief.

Section II

The Legislature shall have Power to declare the Punishment of Treason, with the limitation that said Punishment must include Denaturalization of the Perpetrator, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attained.

Section III

Seditious Acts against the Holy Empire of Rex Omnia and its Throne shall consist of overt conduct, such as speech and organization, that tends toward violent or unlawful insurrection against the established order as established by and within the Constitution, including deliberate or malicious subversion of the Constitution and incitement of acts designed to supplant lawful authority and replace it with such authority as to be against the intent and purposes of Constitutional Law and may include any commotion aimed at direct and open violence against the laws. A Seditionist shall be defined as one who engages in or promotes the interests of sedition, and/or who engages in seditious libel.

Clause I: Seditious conspiracy shall consist of two or more persons in any Region, District, or Territory, or in any place subject to the jurisdiction of the Rex Omnia Empire, conspiring to overthrow, put down, or to destroy by force the Government of the Holy Empire of Rex Omnia, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the Rex Omnian Empire, or by force to seize, take, or possess any property of the Rex Omnian Empire contrary to the authority thereof, they shall each be Denaturalized or imprisoned for a period of not less than and not more than 20 years, or both.

Section I

The Senate, whenever two thirds of all representatives shall deem it necessary, shall propose Amendments to this Constitution. The Senate then must gain the approval of both the Praetor and the objective Premier. If both agree to the amendment, then the amendment shall be defined as a ratified amendment and be deemed law. The Senate may bypass the approval of either the Praetor or Premier if they have a unanimous decision otherwise, if so, then the amendment shall be ratified.

Amendment I

The Keeping and Bearing Arms Act – Insofar as the People have an inherent Right to Life, Liberty, and Property, and to the Protection of that Life, Liberty, and the Health and Well Being of themselves, their families and associates, their Posterity, and their fellow Citizens, as well as to the Protection of their Property and Homes, the Right of the People to Keep and Bear Arms shall not be Infringed, and the Legislature shall neither make nor entertain any legislation, Amendment, or petition designed to infringe upon this Inherent Right.

Amendment II

Right to Self Defense – The Right to Freedom from unjustified Assault or Bodily Harm and Injury being inherent to a Free and Dignified People, the Right to the Defense of Ones Person and Possessions shall not be Infringed, and the Legislature shall make no Law requiring Retreat from unprovoked aggression.

Amendment III

The Free Speech and Assembly Act – The Legislature shall neither make, nor entertain any law or petition prohibiting the freedom of speech, or the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Clause I. The Right of the People to Peaceably Assemble is not inclusive of any language serving to construe that a Right exists protecting Assemblies that act in such a manner as to destroy or damage property, commit acts of assault and battery upon other persons or upon counter-protestors, or to commit violence upon the police or the militia.

Amendment IV

The Freedom of Religion – The Legislature shall make no Law prohibiting or abridging the Right to the Freedom of Religion or the Free Expression thereof, nor shall it entertain Amendment, or petition designed to infringe upon or abridge this Inherent Right.

Amendment V

The Unenumerated Rights Act – The enumeration in this Constitution of certain rights, shall not be construed so as to deny or disparage others retained by the People and belonging to the People alone.

Amendment VI

Praetor Immunity - The Praetor shall not be answerable for his actions; his person shall be sacrosanct. Their acts shall always be countersigned in the manner established by Rex Omnian Law. Without such countersignature they shall not be valid, except as provided by within the scope of this Constitution. The Ministers and Officers of the Government shall be responsible for the conduct of the government; their responsibility shall be determined by Statute.
