[size=100][b]Article 1.[/b][/size] Form of Government
[size=85][i]The Empire of Hartfelden shall be a federal and indivisible sovereign realm. Its form of government shall be that of a constitutional and hereditary monarchy.[/size][/i]
[size=100][b]Article 2.[/b][/size] Territory of the Empire
[size=85][i]The Empire shall consist of the territories of the states of Hartfelden and of all extant imperial possessions. Additional territories may be incorporated into the Empire by law.[/size][/i]
[size=100][b]Article 3.[/b][/size] Powers of the States
[size=85][i]The states shall exercise executive, legislative, and judicial powers within their respective territories. They shall possess jurisdiction over all matters except those reserved exclusively for the Empire.[/size][/i]
[size=100][b]Article 4.[/b][/size] Supremacy of Imperial Law
[size=85][i]Imperial law shall be superior to and take precedence over state law. No state law shall be permitted to conflict with Imperial law or the provisions of this constitution.[/size][/i]
[size=100][b]Article 5.[/b][/size] Matters of the Empire
[size=85][i]The Empire shall possess exclusive jurisdiction over matters concerning foreign relations and national defense.[/size][/i][/box]

[size=100][b]Article 6.[/b] Guarantee of Equality[/size]
[size=85][i]All Hartfelders shall be considered equal before the law. No discrimination upon race, gender, age, religion, or sexual preference shall be permitted.[/size][/i]
[size=100][b]Article 7.[/b] Right to a Trial[/size]
[size=85][i]All Hartfelders shall have the right to a fair and lawful trial by a jury of their peers. No sentence shall be passed except as prescribed by law.[/size][/i]
[size=100][b]Article 8.[/b] Freedom of Emigration[/size]
[size=85][i]All Hartfelders shall be free to emigrate from the Empire at their pleasure. No legal or political repercussions shall be suffered by emigrants.[/size][/i]
[size=100][b]Article 9.[/b] Freedom of Religion[/size]
[size=85][i]All Hartfelders shall be free to confess their faith openly and to establish religious organizations. No person shall be denied their rights based upon religious belief or a lack thereof.[/size][/i]
[size=100][b]Article 10.[/b] Freedom of Speech[/size]
[size=85][i]All Hartfelders shall be free to express themselves by word, writing, print, or any other media. No censorship shall be permitted except as prescribed by law.[/size][/i]
[size=100][b]Article 11.[/b] Freedom of Association[/size]
[size=85][i]All Hartfelders shall be free to associate and to form associations, except for purposes which contravene Imperial law or the provisions of this constitution.[/size][/i][/box]

[size=100][b]Article 12.[/b] Executive Power[/size]
[size=85][i]The executive power in the Empire shall be vested in the Kaiser.[/size][/i]
[size=100][b]Article 13.[/b] Titles of the Kaiser[/size]
[size=85][i]The full title of the Kaiser shall be: His Imperial and Royal Majesty Friedrich I, Kaiser of Hartfelden, King of Tannborn and Kronenberg, Duke of Ansrau, Helmfurt, and Fürstenzell, Margrave of Osterhausen and Delmenfingen, and Lord of Hügelstatt[/size][/i]
[size=100][b]Article 14.[/b] Commander-in-Chief[/size]
[size=85][i]The Kaiser shall be the Commander-in-Chief of the Kaiserlichen Streitkrafte.[/size][/i]
[size=100][b]Article  15.[/b] Pardoning Power[/size]
[size=85][i]The Kaiser shall have the power to pardon and to mitigate punishment.[/size][/i]
[size=100][b]Article  16.[/b] Orders and Distinctions[/size]
[size=85][i]The Kaiser may confer orders and other distinctions. Pursuant to Article 6, orders and distinctions shall carry no privileges.[/size][/i]
[size=100][b]Article  17.[/b] Foreign Realms[/size]
[size=85][i]The Kaiser shall not be permitted to rule foreign realms without the consent of Parliament.[/size][/i]
[size=100][b]Article  18.[/b] Regency[/size]
[size=85][i]The Kaiser may, at any time, appoint a regent to run das Imperium until they relieve them of their position as regent.  The Regent is granted all powers of the Kaiser during this time. In the event the Kaiser does not return when the regency shall end and is gone for longer than a term of a month after the regency should have ended, then the Regent shall take the title of Kaiser.[/size][/i]
[size=100][b]Article 19.[/b] Imperial Oath of Office[/size]
[size=85][i]The Kaiser shall state the following oath before they may be granted their full authority:
“I, [NAME], swear to the peoples of Hartfelden that I shall observe and uphold the Constitution and all Laws of the Empire. I swear that I shall defend and preserve, with all my power, the independence and territory of Empire and that I shall protect the freedom and the rights of all Hartfelders.”[/size][/i]
[size=100][b]Article 20.[/b] Convocation and Closing[/size]
[size=85][i]His Imperial Majesty shall convoke the legislature and close their sessions. The Kaiser may dissolve the two chambers together or either one individually.[/size][/i][/box]

[size=100][b]Article 21.[/b] Executive Functions[/size]
[size=85][i]The Imperial Government shall exercise executive power in His Imperial Majesty’s name.[/size][/i]
[size=100][b]Article 22.[/b] Government Composition[/size]
[size=85][i]The Imperial Government shall consist of the Kanzler and their Ministers[/size][/i]
[size=100][b]Article 23.[/b] Appointment of the Kanzler[/size]
[size=85][i]The Kanzler shall be appointed by the Kaiser with the advice of the Reichstag[/size][/i]
[size=100][b]Article 24.[/b] Executive Orders[/size]
[size=85][i]The Kanzler shall have the power to issue executive orders which shall have the full extent of an Imperial Order[/size][/i]
[size=100][b]Article 25.[/b] Ministerial Responsibility[/size]
[size=85][i]The signature of the minister(s) of which an executive order shall affect shall also be required.[/size][/i]
[size=100][b]Article 26.[/b] Executive Oath of Office[/size]
[size=85][i]The Kanzler shall swear the following oath to enter office;
“I, [NAME], hereby swear to faithfully serve the Kaiser, the Empire of Hartfelden her States and her People. I swear that I shall defend the Empire from foreign and domestic foes, as well as to never neglect my duties as Kanzler.”
The Ministers shall swear the following oath to enter office;
“I, [NAME], hereby swear to faithfully serve the Kaiser, the Empire of Hartfelden her States and her People. I swear that I shall defend the Empire from foreign and domestic foes, and to not neglect my duties as Minister.”[/size][/i][/box]


[box][center][size=200][b]Title V. Legislature[/size][/b][/center]
[size=100][b]Article 27.[/b] Legislative Power[/size]
[size=85][i]The legislative power in the Empire shall be vested in Parliament.[/size][/i]
[size=100][b]Article 28.[/b] Chambers of Parliament[/size]
[size=85][i]Parliament shall consist of the Bundesrat and the Reichstag.[/size][/i]
[size=100][b]Article 29.[/b] The Bundesrat[/size]
[size=85][i]The Bundesrat shall be the upper chamber of Parliament. Its members shall be appointed by the Kaiser and shall serve at His Imperial Majesty’s pleasure.[/size][/i]
[size=100][b]Article 30.[/b] The Reichstag[/size]
[size=85][i]The Reichstag shall be the lower chamber of Parliament. Its members shall be elected by the people through their state. The Reichstag shall have a a seat from each state with an additional seat for every twenty citizens within that state.[/size][/i]
[size=100][b]Article 31.[/b] Impeachment[/size]
[size=85][i]The Reichstag or the Bundesrat may call for the Impeachment of the Kanzler or of a Minister. The motion for an impeachment must go through both chambers as a bill and must reach a two-thirds majority vote.[/size][/i]
[size=100][b]Article 32.[/b] Legislative Oath of Office[/size]
[size=85][i]The members of the Bundesrat and the Reichstag shall swear the following oath to take office;
“I, [NAME], do hereby swear to fulfill my duties in [Reichstag/Bundesrat], and to serve the Kaiser, the Empire and her States, and to serve [the People of my Empire/the People of my State]”[/size][/i][/box]


[box][center][size=200][b]Title VI. High Imperial Court[/size][/b][/center]
[size=100][b]Article 33.[/b] Judicial Power[/size]
[size=85][i]The judicial powers of the Empire shall be delegated to the Kaiserlicher Richter of the High Imperial Court.[/size][/i]
[size=100][b]Article 34.[/b] Kaiserlicher Richter[/size]
[size=85][i]The Kaiserlicher Richter shall have a membership of 3 Kaiserlicher Richter, of which they will each see to legal questions and criminal cases when they are needed to. If there is a request for review another Kaiserlicher Richter will go over and either uphold the first Kaiserlicher Richter’s decision or they shall bring a vote upon the High Imperial Court to change the decision.[/size]
[size=100][b]Article 35.[/b] Judicial Oath of Office[/size][/i]
[size=85][i]The Kaiserlicher Richter shall swear the following oath before taking office;
“I, [NAME], do hereby swear to faithfully and fully serve the Kaiser, the Empire and her States, and to serve the People of the Empire. I swear to fulfill my duties to their full extent and to uphold the constitution and laws of the Empire.”[/size][/i][/box]


[box][center][size=200][b]Title VII. General Provisions[/size][/b][/center]
[size=100][b]Article 36.[/b] Amendments[/size]
[size=85][i]This constitution shall be amendable by a two-thirds majority vote of both chambers and with the legal signature of the Kaiser.[/size][/i]
[size=100][b]Article 37.[/b] Martial Law[/size]
[size=85][i]In an event deemed an emergency the Kanzler may declare Martial Law, in the event of the founder ceasing to exist the Chancellor may take the delegate’s seat themselves or appoint a new delegate as needed. Martial Law may be repealed by the Kaiser, declared by the Kaiser. Martial law shall also be repeal able by a majority vote of the Chambers. During a state of Martial Law, the Kaiser, Regent, Heir or the Kanzler shall be granted full Imperial Rights of the Kaiser, they shall be able to create and destroy laws as well as open and close the Chambers as well as dissolve the government. For a Kanzler to declare Martial Law, in the event the founder nation does still exist, they must have the permission from the Kaiser.[/size][/i]
[size=100][b]Article 38.[/b] War[/size]
[size=85][i]For a state of war to exist the Kaiser or the Kanzler may request the Chambers to declare war, of then which the Chambers will vote. A majority vote is needed to enter a war or declare war. If the Empire is attacked first then the Empire shall automatically be at war, except in cases of normal military gameplay such as chasing or liberating.[/size][/i]
[size=100][b]Article 39.[/b] Citizenship[/size]
[size=85][i]A citizen shall henceforth be legally defined as a member nation of the Empire that has registered on the forums, submitted an application which was accepted, and given the Oath of Citizenship. The Oath of Citizenship shall be;
“I, [NAME], do solemnly swear that I shall be faithful and bear true allegiance to His Majesty Kaiser Friedrich I, and to His Heirs and Successors, and that I shall faithfully obey the constitution of Hartfelden and her laws as well as fulfill my duties as a citizen.”[/size][/i]
[size=100][b]Article 40.[/b] Empire[/size]
[size=85][i]The Empire shall henceforth be legally defined as the states and territories that live under the name the Empire of Hartfelden, these states shall be founded by the Kaiser or the Kaiser shall have control over the founding nation. States may also exist within the region “Hartfelden” as the Kaiser and the Chambers shall decide within further law.  [/size][/i][/box]


[box][center][size=200][b]Title VIII. Temporary Provisions[/size][/b][/center]
[size=100][b]Article 41.[/b] Existing Laws[/size]
[size=85][i]All predating laws to this constitution shall be rendered null and void and shall be archived.[/size][/i]
[size=100][b]Article 42.[/b]  Existing Government [/size]
[size=85][i]The existing government of the Empire shall be stripped of their power except for their noble titles and except for the Kaiser.[/size][/i]
[size=100][b]Article 43.[/b] Existing Citizens[/size]
[size=85][i]All citizens shall be required to respond to a census roll call as well as swear their oath of citizenship in a thread created by the Kaiser. The Census shall last for 72 hours.[/size][/i][/box][/font]
